ANNA Legislative Action Center

Advocacy is one of the strategic issues identified in ANNA's Strategic Plan. ANNA is a leading advocate for nephrology nursing and advocates on behalf of individuals, families, and communities affected by kidney disease. ANNA works closely with partners in the kidney and nursing communities to raise awareness about kidney disease and to educate federal policymakers about the vital role nurses play in patient care.

ANNA works closely with Congress, government agencies, and nephrology care advocacy organizations to help ensure patient access to quality nephrology care.

The Medicare Secondary Payer Act (MSPA) aimed to protect individuals with end-stage kidney disease (ESKD) by ensuring that Medicare would not bear the cost of kidney care services that should instead be primarily covered by group health plans. However, the Supreme Court's 2022 decision in Marietta v. DaVita overturned this provision. Consequently, employer group health plans began excluding crucial kidney care services from coverage, forcing many ESKD patients off their private plans and onto Medicare.

The Kidney PATIENT Act of 2023 (H.R. 5074)

The Kidney PATIENT Act of 2023 (H.R. 5074) prevents the Centers for Medicare and Medicaid Services (CMS) from adding phosphate binders/lowering drugs to the Medicare ESRD PPS until January 2033, unless an intravenous drug is approved by the Food and Drug Administration to control or manage serum phosphate levels. This important legislation would preserve access to oral-only phosphate binders/lowering drugs for individuals living with CKD and reduce the burden on small and independent dialysis facilities.

The Improving Care and Access to Nurses Act

Ask Your Representative to Support the Improving Care and Access to Nurses (I CAN) Act (H.R.2713 and S. 2418)
The Improving Care and Access to Nurses Act (H.R. 2713 and S. 2418) would eliminate practice barriers that adversely affect advanced practice registered nurses (APRNs) in states with full practice authority and strengthen access to care for Medicare and Medicaid beneficiaries. The legislation empowers ARPNs to practice to their full scope of their education and clinical training. In addition, the bill will increase the availability of ARPNs nationwide, help address significant provider shortages, and reduce health inequities in medically underserved areas. Ask your Members of Congress to support Passage of the Workplace Violence Prevention for Health Care & Social Service Workers Act
The Workplace Violence Prevention for Health Care and Social Service Workers Act (H.R. 2663 and S. 1176) requires the Department of Labor (DOL) to address workplace violence in health care, social service, and other sectors. Specifically, the Agency must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence.
